Abstract

Happiness and equilibrium can be achieved in the world only when each and every human is kept on an equal pedestal irrespective of caste, creed, colour, religion or gender. Balance of dignity and status between the genders is not only necessary at the societal level but at the family level as well. This article purports to put forward a treatise on section 6 of the Hindu Minority Guardianship Act, 1956 which gives a preferential right of guardianship to the father of the minor over the mother. Although various judicial pronouncements have been given by the courts taking note of the welfare of the child as a paramount consideration but the impugned section under the Act of 1956 remains untouched.
