Abstract

‘The Constitution’ which is the holy book of India embodies various Rights and Duties upon its citizen. This supreme law of the land contains Article 370 under Part XXI which signifies a special status through a temporary provision and grants the special autonomy to the state of Jammu and Kashmir. Though Jammu and Kashmir is a constituent state of India but the position and relation of this state with the Central Government is totally different as compared to the other states of India. The centre is only iron- handed in three matters, which are defense, foreign affairs and communications. The Article 238 which provided the Reorganization of the Indian states was not applied to Jammu and Kashmir and hence was repealed by the 7th Amendment 1956. Afterwards, Article 370 overrode the provisions of Article 238 and necessitated the special status of Jammu and Kashmir.
