Abstract

It is generally viewed that Intellectual property protection and competition law are odds with each other. Is there really any tussle between intellectual property protection and competition law? Intellectual property law creates and protects monopoly power and the other seeks to exclude it. So, Competition Law and Intellectual Property Law prima facie appear to have conflicting objectives andgoals. These conflicts have in turn brought the emergence of a long-debated topic, which has to beresolved for better understanding of the subjects. Thus, with evolving of jurisprudence in this areaand the emergence of a plethora of cases, the author intends to understand the interface betweentwo streams of law i.e. Intellectual Property Rights (IPR) and Competition law. Competition laoperates towards facilitating the market growth by curbing anti-competitive practices in the market.
